Delivery Terms
Draft version. Effective date: [DATE]
1. Who delivers
Delivery offered through the Site is performed by an independent delivery partner. At launch in Wisconsin, the delivery partner is Mobility City, an independently owned business. Mobility City is not owned or controlled by, and is not an employee, agent, or partner of, [LEGAL BUSINESS NAME] ("we," "us"), the operator of the Site. We are not a carrier and we do not move, store, insure, or take responsibility for any item.
The delivery partner is not exclusive. Sellers and buyers can always arrange their own pickup and transport instead. We may add other delivery partners at any time.
2. How a delivery works
- A buyer asks for delivery of an item that the seller has marked as eligible, and enters a Wisconsin delivery address.
- The Site shows a price. Until the delivery partner confirms it, the price is an estimate. The delivery partner then sends a final quote.
- Nothing is owed until the buyer approves the final quote. The buyer may cancel before approval at no charge. After approval, cancellation online is limited, and the buyer should contact us.
- The seller confirms where and when the item can be picked up. The seller's street address is shared only with the delivery partner. The buyer sees only the seller's city.
- The delivery partner schedules pickup and delivery, photographs the item at pickup (including the serial plate) and at delivery, and records the name of the person who signed for it.
3. Payment
The Site does not collect payment for delivery. After the buyer approves the quote, the delivery partner arranges payment for its fee directly with the buyer, under the delivery partner's own payment terms. The sale price of the item itself is a separate matter between the buyer and the seller.
4. Referral fee disclosure
We may receive a referral fee from the delivery partner, calculated as a percentage of the delivery fee. The fee is paid by the delivery partner out of its own charge. It does not increase the price you pay.
5. What the buyer must do
- Give a correct, complete delivery address in Wisconsin and a phone number the driver can call.
- Tell us truthfully about steps, elevators, and doorway widths. Measure the narrowest doorway the item must pass through.
- Make sure a responsible adult is present to receive the item and sign. If nobody is present, the delivery partner may charge for a return trip.
- Inspect the item at delivery and tell the driver right away about any problem.
6. What the seller must do
- Confirm a correct pickup address and the times the item can be picked up.
- Have the item ready, clean, and accessible, with chargers and accessories that are part of the sale.
- Make sure the listing's description, grade, serial number, and size are accurate.
7. Condition, photos, and the sign-off
Photos taken at pickup and delivery are kept as a record. They show the condition the driver saw. They are not an inspection or a guarantee. The item remains used and sold as is. The delivery partner's pickup photos and the buyer's sign-off help sort out later disagreements, but we do not decide those disagreements.
8. The Safety Checked badge and safety check add-on
If a buyer orders a safety check and the delivery partner marks it passed, the listing may show a "Safety Checked" badge. This is a visual and basic function check by the delivery partner. It is not an inspection by us, a repair, a certification, or a guarantee, and it does not mean the item is suitable for any person.
9. Damage, loss, and claims
The delivery partner is responsible for its own services, insurance, and claims handling. Questions or claims about damage or loss in transit should go to the delivery partner first. We are not an insurer, and we are not responsible for damage, loss, delay, or injury arising from delivery. We will help you reach the delivery partner and will record any issue you report through the Site.
10. Where delivery is available
At launch, delivery is available only to Wisconsin addresses, for items located in Wisconsin. Distances and prices are based on straight-line measurements and posted rates and may differ from real driving distances. The delivery partner may decline a job it cannot do safely.
11. Your information
To complete a delivery we share the buyer's name, phone number, and delivery address with the delivery partner, and the seller's address and pickup notes with the delivery partner. We share the seller's city with the buyer and the buyer's city with the seller. See the Privacy Policy.
12. Other terms
These Delivery Terms add to our Terms of Use. If they conflict about delivery, these Delivery Terms control. [ATTORNEY: review the carrier relationship, referral arrangement, limitation of liability, and any state licensing or insurance requirements for the delivery partner.]
