Buyer Agreement

Used Mobility Market ("we," "us") is run by [LEGAL BUSINESS NAME]. This Buyer Agreement applies when you contact a seller or use the site to find equipment. By doing so, you agree to it.
1. What we are
Used Mobility Market is a place where people post and find used mobility equipment. We are not the seller, we do not own the items, and we do not inspect, repair, fit, ship or guarantee anything. We do not take payment. You and the seller make your own deal.
2. Who can buy
You must be at least 18 and able to make a legal contract. If you are buying for someone else (for example a parent), you are responsible for making the deal and for making sure the item is right for them.
3. Before you buy, please
- Read the whole listing and ask questions.
- Ask for more photos, the age, the repair history, and the battery condition.
- See the item in person if you can, or have someone you trust look at it.
- Check the item's size, weight limit and fit. Used mobility equipment can be unsafe if it is the wrong size or setup. Talk to your doctor, therapist or an equipment specialist before choosing what is right for your needs.
- Check whether the item has been recalled. You can search the maker's name and model online and on government recall sites.
- Ask whether any part of the item is leased, rented or owned by an insurer.
4. As-is, no guarantee
- Items are sold by individual sellers as-is, with all faults, unless the seller clearly promises something else in writing. We do not promise that a listing is accurate, that an item is safe, legal to sell, or right for you, or that a seller is honest.
- We do not give medical advice. Nothing on the site is medical, therapy or safety advice.
- Any warranty or return is only what the seller promises, and the seller is responsible for it, not us.
5. Money and scam safety
We do not hold or move money. You and the seller choose how to pay. Protect yourself:
- Do not send money to someone you have not verified, especially by wire, gift card, prepaid card, crypto or a payment app to a stranger.
- Be careful of prices that look too good, sellers who cannot meet, and pressure to act fast.
- Meet in a public place, or take a friend. Do not go alone to an unknown place.
- Test the item before you pay, if you can.
- Get a written receipt with the date, item, serial number and price.
Report suspicious listings with the Report button or at the contact form.
6. Delivery
You and the seller decide how the item gets to you: pickup, delivery by the seller, or a carrier you choose. In Wisconsin and Michigan, the site may offer Mobility City (1853 N Casaloma Dr, Appleton, WI 54913; (920) 504-3960; agbwi@mobilitycity.com) as an optional delivery choice. Mobility City is an independent business and is not owned by us. It is not our employee or agent, and it is not the only choice. You are never required to use it. See our Delivery Terms. If you hire a carrier, your deal is with the carrier, including price, timing, damage and insurance. We do not set the price, take the payment or guarantee the delivery. Ask the carrier for their terms and for proof of insurance.
7. Contact and privacy
We pass your message to the seller using the site's contact method. Do not post sensitive personal details in a message. We will not sell your email. See the Privacy Policy for how we handle your information.
8. Your behavior
Do not harass anyone, send spam, pretend to be someone else, post false reviews or reports, or use the site to commit fraud. We may close any account at any time.
9. Limits on our responsibility
- To the fullest extent the law allows, we are not responsible for any loss, injury, damage or dispute arising from an item, a seller, a meeting, a payment, or a carrier.
- To the fullest extent the law allows, our total responsibility to you for any claim is limited to the fees you paid us in the 12 months before the claim, or $100 if you paid none.
- Some states do not allow some limits. In that case, the limits apply as far as the law allows.
10. If you have a problem
First, contact the seller. If you think the listing was a scam or unsafe, report it at the contact form and, if appropriate, to your local police, your state attorney general, or the Federal Trade Commission (reportfraud.ftc.gov). We cannot refund money or force a seller to act, but we will review reports and may remove listings and accounts.
11. Disputes and law
Wisconsin law applies. Claims will be brought in the state or federal courts for [COUNTY] County, Wisconsin.
12. Changes
We may update this Agreement. If we make a big change, we will post it on the site or email you. If you keep using the site after that, you accept the update.
