Copyright and Complaint Policy

Used Mobility Market lists items posted by users. We respect other people's rights. This policy explains how to report (a) copyright infringement, and (b) unsafe, false, stolen, or prohibited listings.

Send the agent a written notice that includes all of these:

  1. Your name, address, phone and email.
  2. A description of the copyrighted work you say was copied (for example, your photograph).
  3. The web address (URL) of the listing or page that has it, with enough detail for us to find it.
  4. A statement that you believe in good faith that the use is not authorized by the owner, its agent or the law.
  5. A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner.
  6. Your physical or electronic signature.

Knowingly making a false claim can make you liable for damages (17 U.S.C. 512(f)).

3. What we do

  1. We review the notice promptly.
  2. If it is complete, we remove or disable the listing.
  3. We email the person who posted it, with a copy of the notice.
  4. We keep a record of the notice and our response.

4. Counter-notice (if your content was removed by mistake)

If you believe a removal was a mistake or that you have the right to use the content, you may send the agent a counter-notice that includes:

  1. Your name, address, phone and email.
  2. A description of the removed content and where it was before removal.
  3. A statement, under penalty of perjury, that you believe in good faith the content was removed by mistake or misidentification.
  4. A statement that you agree to the jurisdiction of the federal court for the district where you live (or, if outside the United States, any judicial district where we can be found), and that you will accept service of process from the person who made the complaint.
  5. Your physical or electronic signature.

We will send the counter-notice to the complainant. Unless the complainant tells us within 10 business days that they have filed a court action, we will restore the content within 10 to 14 business days after receiving your counter-notice.

5. Repeat infringers

We will close the account of anyone who is a repeat infringer.

6. Reporting an unsafe, false, stolen or prohibited listing

Use the Report button on the listing or email the contact form. Please tell us:

  • The listing link or title.
  • What is wrong (scam, stolen, unsafe or recalled, misleading photos or condition, banned item, harassment, other).
  • Anything you can show us (photos, messages, police report number).

We review reports promptly. We may hide the listing while we look, remove it, warn or close the account, or take no action. We cannot decide disputes between a buyer and a seller, and we do not give legal advice. If you think a crime has happened, contact your local police.

7. Product recalls

If you know that an item listed on the site has been recalled, tell us and include the recall notice if you can. We may remove the listing or add a warning.

8. Appeals

If we removed your listing or closed your account, you may email the contact form within 30 days to ask us to look again. We are not required to restore anything.
